Application
- These general rental conditions apply to reservations and agreements relating to the holiday home "La Porte à Côté" located at 1 Vierge de Blehou, Sainteny (Terre-et-Marais), 50500, Normandy, France.
- In these general rental conditions, the term "tenant" is understood to mean: the person who enters into a rental agreement with us with regard to the rental of the holiday home.
- These general terms and conditions apply regardless of your (previous) reference to any own terms and conditions or to other general terms and conditions. We disclaim any terms and conditions to which you refer or which are used by you.
- Agreements deviating from these general terms and conditions are only valid if agreed in writing.
Article 1 - Reservations
- We only accept reservations from persons who are 18 years of age or older. Reservations by persons under that age are not valid. We reserve the right to refuse a reservation at any time, without giving reasons.
- After you have made a reservation, you will receive a confirmation, the general rental conditions and an invoice from us within five days. The conditions described in Article 2 apply to payment of the invoice.
- We ask you to check these documents for accuracy and to report any inaccuracies to us immediately. If you have not received a confirmation of receipt from us within 10 days of making the reservation, please contact us. If you fail to make this notification, you can no longer invoke the reservation, it has expired.
- An agreement is concluded between you and us at the moment we have confirmed the reservation to you. The agreement concerns the rental of the holiday home for recreational use, which by its nature is of short duration.
Article 2 - Payment
- The following conditions apply to payment:
- Payments must be made through the cashless route;
- You must pay 25% of the invoice amount within 14 days of the invoice date . The remaining invoice amount of 75% must be paid one month before the arrival date.
- If your reservation is within one month before the arrival date, you must transfer 100% of the invoice amount to us in one form upon receipt of the invoice.
- Payments must be made by bank transfer to IBAN: NL25ASNB8830414433 in the name of Meisner R en/of Meisner Barneveld M at Sainteny, stating the reservation number.
- By paying a (partial) payment of or the entire rent, you confirm that you have read and agree to the general rental terms and conditions. The lease ends by operation of law after the expiry of the agreed period.
- In the event of late payment, as described in this article, you will be in default immediately after the payment term has expired. In that case, we reserve the right to cancel your reservation and dissolve the agreement.
Article 3 - Deposit
- A deposit of € 150.00 will be charged to the tenant, which serves to guarantee damage and/or costs in the broadest sense of the word that we may suffer in the event of non-compliance with the obligations of the tenant as a good tenant and those accompanying the tenant.
- The deposit must be paid, in cash, on arrival.
- In the event that the deposit is not paid, we are entitled to deny the tenant access to the holiday home. If you fail to pay the deposit, we are also entitled to terminate the agreement with immediate effect.
- The deposit or any remainder thereof will be refunded or refunded to an account to be specified by the tenant after settlement of any claims (e.g. damage to inventory/holiday home and/or other costs) before the departure of the tenant, after the final inspection. Any (further) claim for compensation will be nullified by us by this refund.
- If in the event of (possible) damage it turns out that the deposit is not sufficient to compensate the full damage suffered, we reserve the right to hold you liable for the (remaining) damage.
Article 4 - Amendments
- If the tenant, after the conclusion of the booking/agreement, wishes to make changes to the booking, we are not obliged to comply with this. It is at our discretion whether and to what extent the desired changes are accepted. In principle, changes can be made in good consultation and if possible. If changes are not possible, for example, but not exclusively, due to overlap with other bookings, the original entry remains in force.
- If, after the conclusion of the booking/agreement, the tenant wishes to change the period of stay to a different or non-successive/consecutive period of stay, the cancellation provisions as stated in article 5 of these rental conditions apply. In any case, a period of stay is understood to mean a period that does not fall within the period of stay reserved by the tenant (and confirmed by the landlord).
Article 5 - Cancellation
Cancellation by the tenant must always be made in writing (by post or by e-mail). The following conditions apply:
- Partial payments will not be returned by the renter in the event of cancellation.
- In case of cancellation up to 42 days before the planned day of arrival, 25% of the rent is due.
- In case of cancellation up to 28 days before the planned day of arrival, 50% of the rent is due.
- In case of cancellation from seven days to the planned day of arrival, 75% of the rent is due.
- If you have not arrived within 24 hours of the agreed date without further notice, this will be considered a cancellation and 100% of the rent will be due
- In case of cancellation on our part, any payments already paid will be refunded.
Article 6 – Receipt of key.
- The tenant will receive the key on arrival or can take it from the key safe with the code provided before arrival.
- The tenant is never entitled to duplicate the key for any reason whatsoever. If the tenant does so, the tenant will owe a fine of € 500, regardless of the actual costs. The key to the holiday home is made available by us on loan to the tenant. The key remains our property and must be returned to us after the period of stay on the departure date or returned to the key safe.
- In the event of loss, theft or any other way of losing the key, the cost of making a duplicate key will be deducted from the deposit. For verification, we ask the tenant to identify himself before the (copy) key is handed over.
- All costs incurred because you do not deliver the house on time will be recovered from you. Goods found after your departure will be kept for you for a reasonable period of time, but we will not take any responsibility for this. Subsequent requested shipping is only possible at your own expense.
Article 7 - Accommodation in the holiday home
The holiday home can be booked per day, taking into account the following points:
- The tenant must be present at/during the key handover and (entire) stay.
- The tenant and other users must behave as a good tenant during the stay in and around the house.
- On the day of arrival you can use the holiday home from 15:00. On the day of departure, you must have left the holiday home by 11:00 a.m. at the latest.
- The holiday home is smoke and vape free. Smoking is allowed outside in the garden and on the terraces. Make sure to keep the area free of ashes and cigarette buds.
- Open fires in and around the house, in the garden and on the terraces are prohibited.
- Dogs are allowed. Maximum 2.
- Dogs are allowed to roam freely in the house and in the garden/near the terraces. Outside of that, the dogs must be on a leash.
- The tenant must clean up the excrement of the dog(s) himself and deposit it in the appropriate waste bin.
- The rent does not include final cleaning but includes bed and linen.
- For the final cleaning, € 30 per rental period will be charged.
- Barbecuing is allowed, in consultation, with the barbecue provided. The barbeque should be cleaned before departure.
- The use of water and electricity is included, but we kindly ask you to handle this reasonably.
- Accommodation of more people in a holiday home than agreed (at the time of booking), or than the maximum of three people applicable to the house is expressly not permitted without our permission, unless otherwise agreed in writing. Not complying with this request may lead to the premature termination of the lease on our part, without restitution of the rent.
- Moving cupboards and beds, as well as sound or television equipment or taking any part of the (inside) inventory outside is expressly not permitted, with the exception of the crockery/glasses and cutlery for your meals outside.
Article 8 - Force majeure
Force majeure on our part exists if the execution of the agreement is wholly or partially, temporarily or otherwise, prevented by circumstances beyond our control, including, but not limited to, the threat of war, staff strikes, blockades, fire, floods and other disruptions or events.
Article 9 - Liability/complaints/damage
- The tenant and other users are fully and jointly liable for all damage caused to the house, the inventory and all items belonging to the rented object during the relevant rental period in the holiday home, unless the tenant and other users can make it plausible that the damage cannot be attributed to them. We therefore recommend that you inspect the inventory carefully for defects and damage upon arrival at the holiday home. If you notice any damage or defects, please report this to us immediately.
- We accept no liability for theft, loss or damage to goods or persons, of any kind, during or as a result of the stay in the holiday home.
- We accept no liability for construction activities on the (main) roads etc. in the vicinity of the holiday home. We accept no liability in the event of failure or deactivation of technical equipment, utilities, the non-functioning or partial non-functioning of the internet and/or TV.
- The costs of normal maintenance and repair of defects are at our expense. If defects occur, the tenant must inform us immediately and follow our instructions as much as possible.
- If you still want to submit a complaint, it must be submitted to us in writing and motivated within 14 days after leaving the holiday home.
Article 10 - Departure and final cleaning
After the end of the period of stay, the tenant must:
- To leave the house (broom) clean and tidy. In the event of incorrect use or incorrect abandonment of the holiday home, additional (cleaning) costs may be charged to the tenant.
- Everything washed clean, dried and put back in the closet.
- Duvet covers and sheets must be removed and placed on the floor together with the other linen (towels, etc.) next to the bed.
- Leaving the dishwasher and fridge clean and empty.
- Take food with you and not leave it in the cupboard(s) and/or fridge/freezer.
- The cushions of the garden furniture (please) be put in the appropriate bins.
- Emptied garbage cans.
- Report any breakage and/or damage to us.
